South Dakota Road Laws
Generally South Dakota traffic laws follow the US Uniform Traffic Code.
For instance, right turns on red are permitted unless otherwise
posted.
Speed
Limits: Interstate
Highways: Maximum
75 mph. Speeds are posted lower around Rapid City, Sioux Falls and
North
Sioux City however. Other Highways: Maximum 65 mph unless otherwise
posted.
Speed limits on most of the scenic roads in the Black Hills are 45 mph
or slower. Curves may be posted as little as 15 mph. City Streets: 25
mph
unless otherwise posted.
Seatbelts:
Drivers and front seat
passengers
must use seatbelts. However vehicles cannot be stopped for seatbelt
violations
alone. A child restraint system (infant seat) is required for children
under the age of 5.
A vehicle can be stopped if a child is not properly restrained.
Headlights:
Must be used between
1/2-hour
after sunset and 1/2-hour before sunrise and at other times when
necessary
for safe driving. 
Motorcycles:
Helmets are not required
for adults; however all persons under the age of 18 must wear approved
helmets. Eye protection or windshield is required. Rear view mirror
required.
Handle bars may not be no more than shoulder high.
DWI/DUI:
Operators with a blood
alcohol
level of 0.10 percent or higher must not operate a vehicle. Implied
consent
for breathalizer and/or blood tests. Legal drinking age for all
alcoholic
beverages is 21. (DWI, Driving While Intoxicated; DUI, Driving Under
the
Influence.)
Bicycles:
Bicycles may be ridden on
any roadway in South Dakota except in areas where they are specifically
forbidden. Bicyclists must obey all traffic laws. (Note: Bicycles may
use
portions of the South Dakota Interstate Highway System.)
ATVs:
South Dakota registered and licensed ATVs may be used on most roads
except the Interstate Highway system. ATVs must be at least 250cc or
larger and have a horn and mirror to be road legal. ATVs road
licensed in other states may be used on South Dakota roads. Helmets are
not required for ATV use except for persons under the age of 18,
however eye protection or a windshield is required for on-road usage.
